Disclaimer and Freedom of Choice：

The parties seeking for referral of mediator (hereinafter, the “parties”) from Hong Kong Professional Mediation Association (hereinafter, the “HKPMA”) acknowledge that they shall have the right of freedom of choice to accept or decline a mediator being referred by HKPMA.  The mediator acknowledges that he/she shall have the right of freedom of choice to accept or decline parties referred by HKPMA. Both the parties and the mediator shall indemnify and hold harmless HKPMA and its office bearer(s) and its agents and employees from and against any and all claims, damages, losses and expenses, including, but not limited to, reasonable attorney fees through all legal, administrative and enforcement proceedings arising out of or resulting from, including but not limited to, any services, agreements, acts or omission, etc between the parties and the mediator, despite of the fact that they have paid or have not paid any fees to HKPMA.
