Step 1: Request for Mediation (all forms are available on our website http://www.mediatorassociation.org/en/artcle.asp?id=12 ). Please fill in Form M01, Request for Mediation. You will also discover an estimation of charges involved for mediation on the form.
Step 2: Once the form M01 is received, staff of our association shall contact you to verify necessary information and would also offer assistance if necessary.
Step 3: An invitation to Mediate would be issued to the opposite party. There would be usually 14 days for the opposite side to reply.
Step 4: If reply on step 3 is positive, a mediator with most suitable experiences for the case from the association would be proposed to both parties. Detail fees for mediator, venue, etc… would be quoted to both parties, too.
Step 5: If both parties accept the proposed mediator, the association would inform the mediator to contact with both parties directly. The mediator would confirm with both parties the date and venue for mediation. The mediator would also arrange all necessary documents for all parties.
Step 6: After mediation is conducted and an agreement is made between parties, an mediation agreement would be signed. If there is no agreement being made, a mediation certificate would be issued to both parties confirming both parties have joint the mediation with time, date & the said outcome.
Step 7: If there is no agreement being made, both parties could consider going for Arbitration or to the Court in order to resolve their disputes. The association could also assist both parties to find a suitable Arbitrator for them.
